Article 1 – Definitions

In these general terms and conditions, the following is understood:

Online course:
Digital educational content, consisting of videos, texts, assignments, downloads, and possibly live or recorded sessions.

Entrepreneur:
The New Mom Club, registered with the Chamber of Commerce under number 66405521.

Participant:
The natural person (consumer) who enters into an agreement with the Entrepreneur.

Agreement:
The distance agreement between the Entrepreneur and the Participant regarding participation in an online course.

Article 2 – Applicability

These general terms and conditions apply to every offer from The New Mom Club and to every agreement concluded at a distance.

Deviations from these terms are only valid if expressly agreed upon in writing.

The applicability of any general terms and conditions of the Participant is expressly excluded.

Article 3 – Conclusion of the agreement

The agreement is concluded at the moment the Participant accepts the offer and the payment is successfully completed.

After purchase, the Participant will receive a confirmation and access to the online course via email.

Article 4 – Prices and payment

All prices mentioned are in euros and include VAT, unless stated otherwise.

Payment must be made in full in advance.

In the event of non-payment, The New Mom Club reserves the right to refuse or terminate access to the course.

Article 5 – Right of withdrawal & 14-day money-back guarantee

Right of Withdrawal
The Participant acting as a consumer within the meaning of Article 6:230g of the Dutch Civil Code has the right to dissolve the agreement within fourteen (14) days after purchase without giving reasons.

Exercising the right of withdrawal
To exercise the right of withdrawal, the Participant must send an unambiguous statement by email to [email address] within the withdrawal period.
After a valid withdrawal, the full purchase amount will be refunded within fourteen (14) days via the same payment method.
After the refund, access to the online course and any associated community will be immediately terminated.

Digital content and immediate delivery
By purchasing the online course, the Participant expressly agrees to the immediate delivery of digital content and acknowledges that the right of withdrawal may expire once the delivery has commenced, in accordance with Article 6:230p sub g of the Dutch Civil Code.

Limitation of the right of withdrawal and money-back guarantee
The right of withdrawal and the 14-day money-back guarantee expire if the Participant performs one or more of the following actions within the withdrawal period.

Exclusions
The right to withdraw and refund expires if:

• more than fifty percent (50%) of the online course content has been viewed, followed, and/or downloaded;
• the online course (or a substantial part of it) has been completed within the withdrawal period;
• the Participant has demonstrably actively participated in live components of the program, including but not limited to live Q&A sessions, interactive calls, or group meetings. Active participation includes, among other things, asking questions, interaction via chat, or other forms of direct interaction. Watching recordings does not count as live participation;
• there is demonstrable abuse of the right of withdrawal or the money-back guarantee.

Proof and administration
In assessing the use of the course, the administration and log data of the provider are leading. This includes viewing behavior, progress tracking, attendance at live sessions, and established interaction.

Article 7 – Intellectual property

All intellectual property rights related to the course are held by The New Mom Club.

It is not permitted to reproduce, disclose, or exploit course materials without written permission.

Article 8 – Liability

The New Mom Club is not liable for indirect damage, consequential damage, or lost profits.

Participation in the course is at one's own risk.

The New Mom Club does not guarantee a specific result; the course involves a best efforts obligation, no obligation to achieve results.

Liability is in all cases limited to the amount paid by the Participant for the course.

Article 9 – Force majeure

In the event of force majeure, The New Mom Club has the right to suspend its obligations or terminate the agreement without compensation.

Force majeure is understood to mean any circumstance beyond the control of The New Mom Club.

Complaints must be reported in writing within 14 days of discovery via Rosanne@thenewmomclub.nl

The New Mom Club will respond substantively within a reasonable time.

This agreement is exclusively Dutch law applicable.

Disputes will be submitted to the competent court in the Netherlands.

• If any provision of these terms is found to be void or unenforceable, the remaining provisions shall remain in full force.

• The New Mom Club reserves the right to change these general terms and conditions.
